With the explosion of cell phones, the ability to gamble has gone digital. This has led to the growth of an industry that allows you to place bets on sports and other games. Some states already allow you to do this. Others are set to do so in the near future. While the legalization of online gambling is slow, the industry is growing. In the coming years, nearly half of the United States will be able to wager on sporting events.
There are several types of online gambling that are currently available in the United States. Online casinos, sportsbooks, and virtual poker are some of the most common options. Many of these options allow you to place your bets using your phone, tablet, or computer. However, a number of issues surround this form of gambling.
Gambling is defined as any activity involving the sale of chances, pool-selling, or any other activity that involves bets. It is a broad term that also includes casino games, lotteries, and bookmaking. The activities that constitute gambling in New York State include: placing bets, conducting lottery or lotteries, and maintaining dice, roulette wheels, and other gaming devices.
Illegal gambling in the United States involves several federal criminal statutes. These include the Wire Act, the Illegal Gambling Business Act, and the Travel Act. Moreover, the federal law also reinforces state laws in cases where the presence of an interstate element challenges the enforcement policies of the state law.
Illegal Internet gambling is also illegal under the federal Wire Act. This law prohibits anyone from knowingly sending or receiving bets, contests, or other forms of gambling from one state to another.
In addition to the Wire Act, the Illegal Gambling Act also bans Internet gambling. Both of these laws are enforced by the Justice Department. Moreover, the Federal Communications Commission has the power to regulate common carriers, including Internet service providers. If the Commission believes a service provider has a responsibility to stop providing or leasing facilities, it can shut them down. Similarly, the Federal Trade Commission can prosecute a person if they provide or receive false advertising.
Although the Commerce Clause of the Constitution provides some protection to speech, questions have been raised about whether such legislative powers exist. Since the commercial nature of the gambling business seems to satisfy some of those concerns, the industry is moving quickly towards offering more robust online gaming options. For example, Ohio is moving toward legalizing sports betting in the next few years. Governor Mike DeWine signed House Bill 29 into law in late December. Currently, the state has eleven locations for true gambling.
Indiana beat Illinois to the sports betting table by almost a year. Before that, most types of straightforward gambling were illegal in the state. But the legislature passed a bill allowing the state to permit sports betting. Once this law is in place, operators will be able to apply for a license. When this is done, they will be permitted to offer online IN sportsbooks.
